City National, part of Markel, submitted a commercial general liability filing in Vermont tied to Foxquilt that was later disapproved pending response by regulators.
The April 8, 2026 filing included endorsements covering contractors errors and omissions, miscellaneous professional liability, abuse and molestation, intellectual property exclusions, special events exclusions, and weapons exclusions. Foxquilt’s proposed Contractors Errors and Omissions endorsement would have covered property damage tied to contractor wrongful acts while excluding exposures such as asbestos, pollutants, fungus, lead, delays, subcontracted work, and EIFS claims.
Vermont regulators objected to several exclusions, including asbestos, pollution, toxic drywall, silica, assault and battery, physical abuse, weapons, and alcohol-related exclusions tied to special events. The department also rejected a proposed exclusion for continuous or progressive injury or damage, saying it could create “substantial uninsured exposure” for policyholders.
The filing also included an intellectual property exclusion removing coverage for claims tied to copyrights, trademarks, patents, unfair competition, trade secrets, and Computer Fraud and Abuse Act violations, along with a Vermont-specific endorsement designed to prorate losses across affiliated policies.
