Employers Files Initial Excess Workers’ Compensation Program in Kansas

Employers has filed its initial Excess Workers’ Compensation program in Kansas, offering coverage for qualified self-insured employers. The filing includes the Self-Insured Excess Workers Compensation and Employers Liability Indemnity Policy and 49 supporting endorsements addressing complex exposures such as communicable diseases, engineered nanoparticles, and federal acts like FELA, Longshore, and Defense Base.

The program requires insureds to maintain a TPA or be approved for self-administration of claims, with Employers Assurance granted electronic, read-only access to claims systems. Pricing is done on an individual risk basis and includes a distribution load for agent commissions. Eligibility requires a minimum $100,000 self-insured retention, and the filing introduces Kansas-specific rules stating that cancellation or nonrenewal automatically revokes self-insured status in the state.
