Berkshire Hathaway Seeks Excess Workers’ Comp Rates For Nevada Employer

Berkshire Hathaway Homestate Insurance Company submitted a workers’ compensation consent-to-rate filing in Nevada for Resurfacing of Nevada, Inc., requesting approval to charge rates above the filed manual levels.

The filing reflects an effective date of March 10, 2026, and applies to a standard workers’ compensation policy covering the period through March 2027.

The insurer is seeking the excess rate due to unfavorable loss experience and what it describes as inadequate filed rates to cover claim frequency. As part of the filing, the estimated annual premium increases from $38,667 at filed rates to $44,255 under the proposed excess rate—an increase of roughly 14%.

Rate adjustments were applied across key classifications, including:

  • Code 5521 increasing from 6.186 to 7.114

  • Code 8810 increasing from 0.276 to 0.317

Consent-to-rate filings in Nevada require policyholder acknowledgment that the premium deviates from standard rates. The insured signed the form on March 12, 2026.

The filing also outlines workplace safety measures implemented by the employer to mitigate future losses, including monthly safety meetings, use of protective equipment, weight belts, and daily supervisory job site reviews.

The submission remains under review with the Nevada Division of Insurance.
