Cross Country Motor Club, Inc., which operates as Road America Motor Club, submitted a form filing in New Mexico for a new Key Assist Plus Membership Agreement covering roadside and vehicle key services.
The program represents a new offering that has not previously been reviewed by the New Mexico Division of Insurance.
Key Assist Plus is a motor club membership product rather than an insurance policy. The agreement explicitly states that the program does not replace vehicle insurance coverage and is not an automobile physical damage or liability insurance contract. Benefit reimbursements under the program are backed by a contractual liability policy issued by Old Republic Insurance Company.
The membership provides a bundle of vehicle assistance services centered on key replacement protection and roadside assistance. Coverage includes locksmith services if keys are locked inside the vehicle, with up to $100 per occurrence covered for lockout assistance. The program also reimburses the cost of replacing lost, stolen, or damaged vehicle keys, including programming, with limits of up to $500 per occurrence for Class 1 vehicles and up to $800 for Class 2 vehicles. Replacement claims are limited to one occurrence per year during the membership term.
The product also includes 24 hour roadside assistance benefits covering towing up to 50 miles, battery jump starts, flat tire service, fluid delivery, and vehicle extrication. Additional services include taxi assistance, rental vehicle assistance, and driver’s valet coordination, each with a $50 per occurrence reimbursement limit.
Other features include emergency message relay services, custom trip routing assistance, and a $1,000 reward for information leading to the arrest and conviction of a person who steals the member’s vehicle.
Membership terms are set at the time of purchase and default to a 36 month term if not otherwise specified. The program can be canceled at any time by the member, with a full refund available within the first 30 days and prorated refunds thereafter depending on the timing of cancellation and any services used.
The program is sold through vehicle dealers in connection with vehicle purchases or leases, though participation is optional and not required to obtain financing for a vehicle purchase.
