Cincinnati Insurance filed a new endorsement for its Management Liability product in New Mexico that excludes coverage related to website accessibility compliance.
The form filing introduces the Third Party Liability Web Content Accessibility Exclusion for use with the company’s Pillar Program. According to the filing description, the endorsement is intended for insureds that indicate they are not compliant with website accessibility standards.
The exclusion modifies the Employment Practices Liability section of the management liability policy. Specifically, it adds language stating that the insurer will not pay, indemnify, or defend any third party claim arising from an actual or alleged failure to comply with or maintain website accessibility standards. The exclusion references widely used standards such as the Web Content Accessibility Guidelines and applies only to Insuring Agreement B of the policy.
Cincinnati said the endorsement is designed to address exposures tied to accessibility-related litigation involving corporate websites. These claims have become more common as businesses face legal challenges alleging that websites do not meet accessibility requirements for individuals with disabilities.
The endorsement takes effect immediately for both new and renewal policies in New Mexico as of March 10, 2026.
