Capacity Updates Cyber Coverage in Florida

Capacity Insurance Company submitted an informational filing in Florida for cyber coverage form changes, acknowledged July 12, 2018. The updates took effect August 15, 2018 for new business and September 1, 2018 for renewals.

The revised Cyber Coverage Insurance form [CDE (FL) 08 18] clarified language and expanded limits. Changes included simplifying “Protected Information” to “Private Information,” amending the Mass Accumulation or Internet Event Exclusion, and increasing coverage limits: PCI fines now carry a $10,000 sublimit, Proceeding Claim Expense rose from 25% to 50% of aggregate with a $10,000 regulatory fine sublimit, and First Party Privacy Breach Expense also increased to 50% of aggregate, with $5,000 for Data Replacement and $10,000 for Extortion.

Filed as a General Liability attachment under ISO’s Commercial Lines Manual (Division Six), the form achieved a Flesch Readability score of 45.3. The Florida OIR noted that while the filing was informational, Capacity remained responsible for compliance with state laws.

The changes reflected an effort to modernize policy language and expand cyber protection at a time when privacy law was quickly evolving.
